Latest Discipline Decisions Summary

The Discipline Committee hears matters regarding allegations of professional misconduct and/or incompetence. When it makes a finding of guilt, a summary of its decision and reasons must be published in the College’s newsletter, Connexions, as well as on the College website and CanLii.

Kwang Won Kim

DISCIPLINE COMMITTEE ORDER

Suspended Kwang Won Kim’s Certificate of Registration (registration number 68303) for a period of five months.

Reprimand:  Terms, Conditions and Limitations on the Member’s Certificate of Registration that include mentorship and coursework.

Contribution of $1,000 towards the College’s prosecution and hearing costs.

Agreed facts: Kwang Won Kim (the “Member”) was employed as an Early Childhood Educator at the Willowbrae Academy (the “Centre”) in Toronto, Ontario. The Member was supervising a group of preschool aged children during naptime. Over a 35 minute period, the Member approached a 2 ½ year old child several times and attempted to force the child to lie down and fall asleep.  The physical contact with the child included forcefully pulling the child by her leg and arm, sitting on the child’s back, hitting the child’s buttocks, holding the child’s head down and grabbing the child’s neck.

A parent of another child in the room watched part of the interaction on live video and reported what was observed to the Centre.

Finding: In its decision, the panel found that the evidence supported findings of professional misconduct.

The Member was found guilty of several acts of professional misconduct (Ontario Regulation 223/08), including that he physically abused a child under his professional supervision, he failed to maintain the standards of the profession, he acted in a manner that would reasonably be regarded by members as disgraceful, dishonourable or unprofessional, and he acted in a manner that is unbecoming of a member.

Penalty: The panel required the member to appear before the Discipline Committee to be reprimanded.  The panel directed the College’s Registrar to suspend the Member’s Certificate of Registration for a period of five months and to impose terms, conditions and limitations on the Member’s Certificate of Registration, including coursework and mandatory mentorship sessions. In addition, the Member was required to contribute $1,000 to the College’s prosecution and hearing costs.

Christine Villani

DISCIPLINE COMMITTEE ORDER

Suspended Christine Villani’s Certificate of Registration (registration number 21887) for a period of five months.

Reprimand: Terms, Conditions and Limitations on the Member’s Certificate of Registration that include mentorship.

Contribution of $1,000 towards the College’s prosecution and hearing costs.

Agreed facts: Christine Villani (the “Member”) was employed as an Early Childhood Educator at the Oakridges YMCA Before and After School Program (the “Program”) in Richmond Hill, Ontario. The Member was supervising a group of kindergarten-aged children in the after school program. During this time, a 5 year old child left the room. The child walked through the Program’s playground and crossed a busy residential street. The Member did not notice that the child had left the Program and was missing.

The child was found by a community member who returned the child to the Program. The child had been missing and unsupervised for 15 minutes and was extremely distressed.The following day, the Member spoke with the Child’s parent and made a dismissive comment in relation to the incident.

Finding: In its decision, the panel found that the evidence supported findings of professional misconduct.

The Member was found guilty of several acts of professional misconduct (Ontario Regulation 223/08), including that she failed to supervise adequately a person under her professional supervision, she failed to maintain the standards of the profession, she acted in a manner that would reasonably be regarded by members as disgraceful, she contravened a law which caused a child to be put at risk, and she conducted herself in a manner that is unbecoming of a member.

Gloria Nancy (Nancy) Choy

DISCIPLINE COMMITTEE ORDER

Suspended Nancy Choy’s Certificate of Registration (registration number 03851) for a period of six months.

Reprimand: Terms, Conditions and Limitations on the Member’s Certificate of Registration that include mentorship.

Contribution of $1,800 towards the College’s prosecution and hearing costs.

Agreed facts: Nancy Choy (the “Member”) was employed as an Early Childhood Educator in the full-day kindergarten class at Montclair Public School (the “School”) in Oakville, Ontario. A child from the Member’s class, who was at the School’s gymnasium with other staff, was given permission to go to the bathroom. The child did not return from the bathroom, and instead left the School without the knowledge of the Member or other staff.

When the children returned from the gymnasium and joined the rest of the children in the Member’s classroom, the Member did not conduct a headcount to ensure that all the children were accounted for. As a result, the Member did not notice that the child was missing.

The child was found walking down a road by a motorist who contacted the police. The child was returned to the School by the police and the child’s parents. In total, the Member had not realized that the child was missing for about 45 minutes.

Finding: In its decision, the panel found that the evidence supported findings of professional misconduct.

The Member was found guilty of several acts of professional misconduct (Ontario Regulation 223/08), including that she failed to supervise adequately a person under her professional supervision, she failed to maintain the standards of the profession, she conducted herself in a manner that could reasonably be perceived as reflecting negatively on the profession, she acted in a manner that would reasonably be regarded by members as disgraceful, dishonourable or unprofessional, she failed to comply with the Act, she contravened a law, which caused a child to be put at risk, and she conducted herself in a manner that is unbecoming of a member.  The panel noted that “shared responsibility for the supervision of the child does not negate the Member’s individual responsibility for the child’s safety.”

Penalty: The panel required the member to appear before the Discipline Committee to be reprimanded.  The panel directed the College’s Registrar to suspend the Member’s Certificate of Registration for a period of six months and to impose terms, conditions and limitations on the Member’s Certificate of Registration, including mandatory mentorship sessions. In addition, the Member was required to contribute $1,800 to the College’s prosecution and hearing costs.

Xin Yu (Sophia) Liu

DISCIPLINE COMMITTEE ORDER

Suspended Sophia Liu’s Certificate of Registration (registration number 58130) for a period of five months.

Reprimand:  Terms, Conditions and Limitations on the Member’s Certificate of Registration that include mentorship.

Contribution of $1,000 towards the College’s prosecution and hearing costs.

Agreed facts: Sophia Liu (the “Member”) was employed as an  Early Childhood Educator at Bizzy Bees Day Care Center (the “Centre”) in Ilderton, Ontario. The Member, along with two other educators was supervising a group of preschool children who were in the Centre yard, getting ready to leave for a visit to the local post office. The Member did not conduct a headcount to ensure all of the children were present, nor did the Member do a physical walk around the yard to ensure all children were with the group.

A child remained in the yard, unsupervised, and exited the yard after the group had left. The child walked a short distance from the Centre and was noticed by a passerby. The passerby had noticed the group of children further down the street, and walked the child over to the group who had reached the post office.

The child had been away from the group for approximately 15 minutes

Finding: In its decision, the panel found that the evidence supported findings of professional misconduct.

The Member was found guilty of several acts of professional misconduct (Ontario Regulation 223/08), including that she failed to supervise adequately a person under her professional supervision, she failed to maintain the standards of the profession, she acted in a manner that would reasonably be regarded by members as disgraceful, dishonourable or unprofessional, and she conducted herself in a manner that is unbecoming of a member.  The panel noted that “the lack of cooperation among staff members neither excused nor diminished the Member’s responsibility to ensure the Child, and all children under her care, were accounted for.”

Penalty: The panel required the member to appear before the Discipline Committee to be reprimanded.  The panel directed the College’s Registrar to suspend the Member’s Certificate of Registration for a period of five months and to impose terms, conditions and limitations on the Member’s Certificate of Registration, including mandatory mentorship sessions. In addition, the Member was required to contribute $1,000 to the College’s prosecution and hearing costs.

Jenny Ng-Nakatani

DISCIPLINE COMMITTEE ORDER

Suspended Jenny Ng-Nakatani’s Certificate of Registration (registration number 16895) for a period of six months.

Reprimand: Terms, Conditions and Limitations on the Member’s Certificate of Registration that include mentorship.

Contribution of $1,000 towards the College’s prosecution and hearing costs.

Agreed facts: Jenny Ng-Nakatani (the “Member”) was employed as an  Early Childhood Educator at Chester Le Early Learning and Child Care Centre (the “Centre”) in Toronto, Ontario. The Member was supervising a group of toddlers at the Centre. In the morning, the Member was outside with the children at the Centre’s playground. A child care aide arrived to replace the Member, who left without advising the aide of how many children were under her supervision.

25 minutes later, the aide brought the children back into the Centre, without realizing that a child was left behind on the playground. The Member met the group in the hallway, but failed to conduct a headcount nor did she check the attendance sheet to ensure all children were present.

30 minutes later, the child was found alone in the playground by two community members The Member had not noticed that the child had been missing.

While the Child was outside and alone on the playground, the Member signed an attendance form indicating that all the children from the group were present, even though it was not true.

Finding: In its decision, the panel found that the evidence supported findings of professional misconduct.

The Member was found guilty of several acts of professional misconduct (Ontario Regulation 223/08), including that she failed to supervise adequately a person under her professional supervision, she failed to maintain the standards of the profession, she acted in a manner that would reasonably be regarded by members as disgraceful, dishonourable or unprofessional, she signed, in her professional capacity, a document she knew or ought to have known contained false, improper, or misleading statements, and she conducted herself in a manner that is unbecoming a member.

Penalty: The panel required the member to appear before the Discipline Committee to be reprimanded.  The panel directed the College’s Registrar to suspend the Member’s Certificate of Registration for a period of six months and to impose terms, conditions and limitations on the Member’s Certificate of Registration, including mandatory mentorship sessions. In addition, the Member was required to contribute $1,000 to the College’s prosecution and hearing costs.

Wayne Delroy Henry

DISCIPLINE COMMITTEE ORDER

Permanently revoked Wayne Delroy Henry’s Certificate of Registration (registration number 22196).

Reprimand. Contribution of $10,000 towards the College’s prosecution and hearing costs.

Facts: As the Member was not present, nor represented by counsel, the Panel proceeded on the basis that the Member denied the allegations as set out in the Notice of Hearing.This matter proceeded as a hearing. The evidence presented by the College established that Wayne Delroy Henry had been registered with the College since 2009. In January 2014 he was arrested and charged with commiting various sexual offences, during a period of approximately seven years, towards a child who was between the ages of 6 and 12 at the time.

In September 2017, after a contested trial, a judge of the Ontario Superior Court found him guilty of one count of sexual assault, one count of invitation to sexual touching involving a minor and one count of sexual interference involving a minor. In February 2018, the Member was sentenced to serve 6½  years in the penitentiary (less credit for 6 days of pre-sentence cunstody). The Member appealed his conviction. In June 2019 the Ontario Court of Appeal dismissed the Member’s appeal and the Member began serving his sentence.

Finding: In its decision, the panel found that the evidence presented by the College supported findings of professional misconduct.

The Member was found guilty of several acts of professional misconduct (Ontario Regulation 223/08), including that he acted in a manner that would be reasonably regarded by members as disgraceful, dishonourable or unprofessional, he contravened a law that is relevant to his suitability to hold a certificate of registration, he contravened a law that has caused or may cause a child who is under his professional supervision to be put or remain at risk, and he acted in a manner that is unbecoming of a member.

Penalty: The panel directed the College’s Registrar to permanently revoke the Member’s Certificate of Registration. In addition, the Member was required to contribute $10,000 to the College’s prosecution and hearing costs.

Rebecca Ann Wardaugh

DISCIPLINE COMMITTEE ORDER

Suspended Rebecca Ann Wardaugh’s Certificate of Registration (registration number 55781) for a period of seven months.

Reprimand. Terms, Conditions and Limitations on the Member’s Certificate of Registration that includes mentorship.

Contribution of $1,000 towards the College’s prosecution and hearing costs.

Agreed facts: Rebecca Ann Wardaugh (the “Member”) was employed as an Early Childhood Educator at the Stirling Little Sprouts Child Care Centre (the “Centre”) in Stirling, Ontario.The Member was supervising a group of preschool aged children during a trip to a nearby park. Prior to leaving the Centre’s yard, the Member did not properly count the children and did not use an attendance binder to verify that all the children were lined up and present. As a result, a three and a half year old child remained in the schoolyard, alone and unsupervised.

The Member also did not conduct a headcount after exiting the Centre’s gate, as well as before and after crossing at least two roads and/or parking lots. As a result, the Member did not notice that the child was missing for approximately 15 – 20 minutes.

Once the Member noticed that the child was missing, she turned the group around to return to the Centre. However, she did not take immediate steps to locate the child and did not call the Centre to report the child’s absence.

In total, the child was alone and unsupervised in the Centre’s yard for approximately 30 minutes, until  a passerby noticed the child in the yard and contacted the Centre.

Finding: In its decision, the panel found that the evidence supported findings of professional misconduct.

The Member was found guilty of several acts of professional misconduct (Ontario Regulation 223/08), including that she failed to supervise a person who was under her care, failed to maintain the standards of the profession, acted or failed to act in a manner that would be regarded by members as disgraceful, dishonourable or unprofessional, and acted in a manner that is unbecoming of a Member.

Penalty: The panel The panel required the member to appear before the Discipline Committee to be reprimanded.  The panel directed the College’s Registrar to suspend the Member’s Certificate of Registration for a period of seven months and to impose terms, conditions and limitations on the Member’s Certificate of Registration, including mandatory mentorship sessions. In addition, the Member was required to contribute $1,000 to the College’s prosecution and hearing costs.
