The Discipline Committee hears matters regarding allegations of professional misconduct and/or incompetence which have been referred by the Complaints Committee following an investigation.
The College is mandated to publish a summary of its disciplinary decisions and reasons when the Discipline Committee makes a finding of guilt. These disciplinary decisions are then published on the College’s website, on our blog and on CanLII, the Canadian Legal Information Institute’s website.
Mandip Kaur
DISCIPLINE COMMITTEE ORDER
Suspended Mandip Kaur’s Certificate of Registration (registration number 65940) for eight months.
Reprimand, Terms, Conditions and Limitations on the Member’s Certificate of Registration that include coursework and mentorship.
Contribution of $1,000 towards the College’s prosecution and hearing costs.
Agreed facts: Mandip Kaur (the “Member”) was employed as a Registered Early Chidhood Educator (RECE) at a child care centre (the “Centre”) in Vaughan, Ontario. The Member was responsible for supervising pre-school aged children. Between December 1, 2017 and February 14, 2018, the Member frequently yelled at the children, grabbed them and/or pulled them by the arms. Three incidents of the Member’s forceful physical interactions with children during this time were observed by a placement student and/or recorded on video.
Finding: In its decision, the panel found that the evidence supported findings of professional misconduct.
The Member was found guilty of several acts of professional misconduct (Ontario Regulation 223/08), including that she physically abused a child who was under her professional supervision; she verbally abused a child who was under her professional supervision; she psychologically and/or emotionally abused a child who was under her professional supervision; she failed to maintain the standards of the profession; she acted in a manner that would reasonably be regarded by members as disgraceful; and she conducted herself in a manner that is unbecoming of a member.
Penalty: The panel required the Member to appear before the Discipline Committee to be reprimanded. The panel directed the College’s Registrar to suspend the Member’s Certificate of Registration for eight months and to impose terms, conditions and limitations on the Member’s Certificate of Registration, including coursework and mandatory mentorship sessions. In addition, the Member was required to contribute $1,000 to the College’s prosecution and hearing costs.

Sarah McGivery Jenkins

Suspended Sarah McGivery Jenkins’ Certificate of Registration (registration number 60778) for seven months.
Reprimand, Terms, Conditions and Limitations on the Member’s Certificate of Registration that include coursework and mentorship.
Contribution of $1,000 towards the College’s prosecution and hearing costs.
Agreed facts: Sarah McGivery Jenkins (the “Member”) was employed as an RECE at a child care centre (the “Centre”) in Vaughan, Ontario. The Member was supervising children at the Centre and forcefully grabbed a child by the wrist, dug her nails into their skin and forced them to sit in a chair. The child was in pain and began to cry. The Member told that child, “You are not going to tell mommy, are you?.” The child sustained several marks on the wrist area. In a second incident on that same day, the Member grabbed another child by the wrist, and then by both arms, causing the child to be upset.
Finding: In its decision, the panel found that the evidence supported findings of professional misconduct.

Kimberley Colleen Serkirk Anderson

Suspended Kimberley Colleen Serkirk Anderson’s Certificate of Registration (registration number 35207) for five months.
Reprimand, Terms, Conditions and Limitations on the Member’s Certificate of Registration that include coursework and mentorship.
Contribution of $1,000 towards the College’s prosecution and hearing costs.
Agreed facts: Kimberley Colleen Serkirk Anderson (the “Member”) was employed as an RECE at a child care centre (the “Centre”) in Whitby, Ontario. The Member and two other non-RECE staff were supervising a group of six toddlers in the Centre’s outdoor play area. One of the gates in the play area had a broken latch andt staff were aware of its condition for several months prior to the incident. Staff did not continuously monitor the gate. A non-verbal child with autism exited the play area, unnoticed, through the gate with the broken latch. A teacher at a nearby school noticed the child walking through the parking lot. It was dismissal time at the school and the play area was busy with adults and children. An adult in the yard called police to assist in locating where the child came from.
Approximately 5-10 minutes after the child had left the play area, the staff counted the children and noticed the child missing. The Member reported the child was missing to the Centre’s management and staff conducted a search. After approximately 15-20 minutes, the police safely returned the child to the Centre’s Assistant Supervisor. The child was unharmed as a result of the incident and was missing for approximately 20-25 minutes.
Finding: In its decision, the panel found that the evidence supported findings of professional misconduct.

The panel directed the College’s Registrar to suspend the Member’s Certificate of Registration for five months and to impose terms, conditions and limitations on the Member’s Certificate of Registration, including mandatory mentorship sessions. In addition, the Member was required to contribute $1,000 to the College’s prosecution and hearing costs.

Steven Richard Campbell
DISCIPLINE COMMITTEE ORDER
Revoked Steven Richard Campbell’s Certificate of Registration (registration number 27653).
Reprimand, revocation of membership, requirement to reimburse the College for funding for therapy and counselling for the children, contribution of $1,000 towards the College’s prosecution and hearing costs.
Agreed facts: Steven Richard Campbell (the “Member”) was employed as an RECE at a child care centre (the “Centre”) in Milton, Ontario. The Member was primarily responsible for supervising children between the ages of 2 and 4. While supervising children during naptime, the Member used his cell phone to take pornographic images of 8 female toddlers and made videos of one child. In some cases, the Member touched the children’s genital areas. The Member was found guilty of several criminal charges, including making child pornography and sexual assault, and was sentenced to 9 years in prison.
Finding: In its decision, the panel found that the evidence supported findings of professional misconduct.
The Member was found guilty of several acts of professional misconduct (Ontario Regulation 223/08), including that he abused physically, sexually, verbally, psychologically and emotionally children under his professional supervision; he failed to maintain the standards of the profession; he contravened a law, which contravention is relevant to his suitability to hold a certificate of registration, he contravened a law which contravention has caused or may have caused a child who was under his professional supervision to be put at or remain at risk; he acted in a manner that would reasonably be regarded by members as disgraceful, dishonourable or unprofessional and he conducted himself in a manner that is unbecoming a member.
Penalty: The panel required the Member to appear before the Discipline Committee to be reprimanded. The panel directed the College’s Registrar to revoke the Member’s Certificate of Registration and required the Member to reimburse the College for funding for therapy and counselling for the children and contribute $1,000 to the College’s prosecution and hearing costs.

Junghwa You

Suspended Junghwa You’s Certificate of Registration (registration number 65302) for seven months.
Reprimand, Terms, Conditions and Limitations on the Member’s Certificate of Registration that include coursework and mentorship.
Contribution of $1,000 towards the College’s prosecution and hearing costs.
Agreed facts: Junghwa You (the “Member”) was employed as an RECE at a child care centre (the “Centre”) in Markham, Ontario. The Member was responsible for supervising a group of toddlers at the Centre. The Member on four separate occasions during naptime attempted to force toddlers to lie down and/or go to sleep. During each incident, the Member engaged in roughly changing children’s positions on the cots and forcing the children to lie down and repeatedly covered the children’s heads with blankets.
Finding: In its decision, the panel found that the evidence supported findings of professional misconduct.
The Member was found guilty of several acts of professional misconduct (Ontario Regulation 223/08), including that she physically abused a child under her professional supervision; she psychologically or emotionally abused a child under her professional supervision; she failed to maintain the standards of the profession, she acted in a manner that would be reasonably regarded by members as disgraceful, dishonourable or unprofessional; and she conducted herself in a manner that is unbecoming a member.
